You have a very reasonable argument. I agree, Harry Potter doesn't hold a candle to LOTR. But even taking politics into consideration ... the HP franchise has been enormously lucrative for Warner Bros.; it's a cultural phenomenon; it spanned eight movies and IDK how many years, which is a lot of work. And giving the win to Harry Potter would make Academy Awards consumers - er, viewers happy.
So, all in all, I can definitely see a nomination for BP and can even imagine a win.
